1. Acceptance of Terms

By accessing or using ChickenJockey ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. ChickenJockey reserves the right to update these terms at any time, and continued use of the Service constitutes acceptance of any changes.

2. Description of Service

ChickenJockey provides Minecraft game server hosting services, including but not limited to:

Virtual private server allocation for Minecraft game servers
Server management tools and control panel access
World upload and management capabilities
Technical support based on subscription tier

3. Account Registration

To use the Service, you must create an account. You agree to:

Provide accurate, current, and complete registration information
Maintain the security of your password and account
Accept responsibility for all activities under your account
Notify us immediately of any unauthorized use
Be at least 13 years of age to use the Service

4. Acceptable Use Policy

You agree NOT to use the Service to:

Violate any applicable laws or regulations
Infringe on intellectual property rights of others
Host, distribute, or facilitate illegal content
Engage in harassment, abuse, or harmful behavior toward other users
Attempt to gain unauthorized access to our systems or other users' accounts
Distribute malware, viruses, or malicious code
Operate servers for activities unrelated to Minecraft gaming
Resell or redistribute Service resources without authorization
Use excessive resources that impact other users' experience

5. Subscription and Billing

ChickenJockey offers subscription-based pricing. By subscribing, you agree to:

Pay all fees associated with your selected subscription tier
Automatic renewal unless cancelled before the renewal date
Provide valid payment information and keep it updated

Refunds may be provided at our discretion within 7 days of initial purchase for unused services. Refunds are not provided for partial months or if your account has been terminated for violating these terms.

6. Service Availability

While we strive for 99.9% uptime, we do not guarantee uninterrupted service. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to notify users of planned maintenance windows.

7. Data and Backups

ChickenJockey provides automated backup systems, but users are responsible for maintaining their own backups of critical data. We are not liable for data loss due to user error, system failures, or circumstances beyond our control. World files and server configurations should be regularly backed up by users.

8. Intellectual Property

ChickenJockey and its logos, designs, and content are protected by intellectual property laws. Minecraft is a trademark of Mojang Studios / Microsoft. ChickenJockey is an independent hosting provider and is not affiliated with, endorsed by, or sponsored by Mojang Studios or Microsoft. Users retain ownership of their world files and custom content uploaded to the Service.

9. Termination

We reserve the right to suspend or terminate your account at any time for violations of these terms or for any other reason at our discretion. Upon termination:

Access to the Service will be immediately revoked
Server data may be deleted after a 7-day grace period
No refunds will be provided for termination due to policy violations

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CHICKENJOCKEY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless ChickenJockey, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which ChickenJockey operates, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration or in the courts of that jurisdiction.
